Workers' compensation

If you are injured at work or on a journey to or from work or injured in other limited circumstances connected with work you should be entitled to compensation. The compensation is paid under the Workers Compensation Act 1951.

Workers' compensation claims include benefits for the following:

  • Claims for weekly payments for incapacity.
  • Claims for medical, hospital, treatment and other related expenses.
  • Claims for lump sum for permanent injury under Schedule 1 of the Workers Compensation Act, 1951.
  • Claims for dependency in the event of the death of a worker in compensable circumstances.

If you are injured, and are being paid workers compensation benefits you should consult with us, as you may have further entitlements that have not been paid, and should be.  You may have a further claim such as a common law claim for damages arising out of the negligence of your employer, or someone else, which have not been explored.

Your benefits may not be being paid at the correct or appropriate rate.

Similarly, you may have unrecognised medical and related expenses, which should be recovered from the employer's insurer.

If you have an injury, which results in permanent disability you may be entitled to receive a lump sum payment.  Generally a permanent injury claim cannot be made unless two years have passed since the injury unless an application is made before that time to the ACT Magistrates Court or that the Court allows the claim to be made or, the injury has stabilised.
